City of Sandy Springs Granted Temporary Restraining Order and Injunction to Abate Nuisance Against Out-of-State Owner of Short-Term Rental Property

During the City Council Meeting held Tuesday, September 2, 2025, City Attorney Dan Lee announced that the Superior Court of Fulton County has granted the City of Sandy Springs a temporary restraining order and injunction to abate nuisance against Failsafe Data LLC.

The Ohio-based company operates a short-term rental property located at 8069 Kenstone Court in Sandy Springs. The legal action follows Failsafe’s failure to obtain both a business license and the required short-term rental permit. Neighbors have submitted multiple complaints regarding excessive noise, increased traffic, and parking issues associated with the property.

Sandy Springs Code Enforcement issued a notice of violations to the property owner on December 31, 2024. Despite this, the owner took no steps to address or correct the violations and failed to appear at two previously scheduled municipal court hearings.

On August 28, 2025, the Honorable Judge Shukura L. Ingram issued the order, requiring Failsafe Data LLC to immediately cease operating and advertising the short-term rental. The order also mandates that the company pay $7,800 in attorney fees to the city and comply fully with all applicable city ordinances. The order is currently pending final signature.
